1. Terms
The www.lcbtutoring.com website (collectively, the “Site”) is owned by LCB Tutoring (“Operator”). By accessing the Site, you (“you”, “Customer”, “your”) agree to be bound by these Website Terms and Conditions of Use (“Terms” or “Agreement”), our Privacy Policy, and all applicable laws and regulations. You agree that you are responsible for compliance with any applicable local laws in your jurisdiction. If you do not agree with any of these Terms, you are prohibited from using or accessing this Site.
 

All content, programs, and materials, including but not limited to lesson content, activities, training materials, videos, articles, and downloadable resources on this Site (the “Materials”), are protected by applicable U.S. copyright and intellectual property law.

LCB Tutoring reserves the right to modify these Terms at any time by posting an updated version on this Site. Your continued use of the Site after any such posting constitutes your acceptance of the revised Terms.

2. Access to this Site
To use this Site, you must have Internet access and pay any associated access fees. System availability and Site access may be limited or unavailable for maintenance or unforeseen issues. LCB Tutoring makes no guarantees as to the uninterrupted availability or performance of the Site.

3. Services
By purchasing a subscription, course, or tutoring package (“Services”) and registering for an account (“Account”), you are granted access to the Services for individual use only, unless otherwise agreed in writing. Group or institutional access requires prior written permission via a signed Service Agreement with LCB Tutoring.

Minors may use the Site only under the supervision and consent of a parent or legal guardian.

4. Intellectual Property
These Terms do not transfer to you any ownership rights in the intellectual property owned by LCB Tutoring or its licensors. All trademarks, service marks, logos, and other intellectual property appearing on this Site remain the sole property of LCB Tutoring or their respective owners. Unauthorized copying, sharing, or resale of any Materials is strictly prohibited and may result in civil and/or criminal penalties.

5. Limited Use License
Upon payment of applicable fees (“Fees”), LCB Tutoring grants you a limited, non-transferable, non-exclusive license to use the Site and Services for personal learning or live tutoring purposes only. You may not reproduce, distribute, record, or sell any portion of the Materials or Services, including for-profit resale or public sharing, without prior written consent from LCB Tutoring.

This license terminates automatically if you violate any Terms herein. Upon termination, your access to the Site and Services will be revoked immediately.

6. Messaging & Communication Consent
By enrolling in LCB Tutoring services, the student (or parent/guardian) consents to receive communications from LCB Tutoring, including but not limited to SMS, email, or automated notifications for scheduling, updates, and promotions. Message frequency may vary. Standard messaging rates may apply.

To opt out of SMS notifications, reply “STOP” to any message. To opt out of email communications, use the unsubscribe link in the email.

 

LCB Tutoring Messaging Policy:

• Lesson reminders: 1–2 messages per lesson

• Payment reminders: as needed

• Promotions: optional, opt-in only

• Opt-out instructions: always included

 

7. Scheduling & Notifications
Students/parents may receive automated reminders for upcoming lessons, cancellations, or rescheduling. Notifications may be sent via SMS, email, or push notifications depending on the platform used.

It is the student’s responsibility to maintain current contact information. LCB Tutoring is not liable for missed messages due to outdated contact information.

​

8. Data Privacy & Use of Information
LCB Tutoring collects contact information, student name, and lesson history to provide services and communicate important updates. Information is securely stored and will not be shared with third parties except as required for educational purposes, payment processing, or legal compliance.

All communications comply with the Telephone Consumer Protection Act (TCPA), CAN-SPAM Act, and applicable state laws.

9. Code of Conduct
All Site users are expected to behave respectfully and lawfully. LCB Tutoring reserves the right to suspend or terminate accounts at its discretion for conduct deemed harmful or inappropriate.

Prohibited actions include, but are not limited to:

• Posting unlawful, defamatory, obscene, or offensive content

• Copying, redistributing, or sublicensing Materials

• Attempting to hack, modify, or reverse-engineer the Site

• Sharing login credentials or allowing third-party access to your Account

• Removing copyright notices or other proprietary marks

• Harassing or disrupting the experience of other users

 

10. Disclaimer
All Materials are provided “as is.” LCB Tutoring makes no express or implied warranties regarding the accuracy, completeness, or fitness for any purpose of the Materials. LCB Tutoring shall not be liable for any damages resulting from the use or inability to use the Site or Materials.

11. Limitation of Liability
In no event shall LCB Tutoring, its owners, affiliates, or suppliers be liable for any indirect, incidental, or consequential damages arising from the use of this Site or Services, including but not limited to data loss, profit loss, or business interruption. Some jurisdictions do not allow such exclusions, so these limitations may not apply to you.

 

12. Indemnification
You agree to indemnify and hold harmless LCB Tutoring, its owners, employees, and affiliates from any claims, damages, or expenses arising from your violation of these Terms or misuse of the Site or Services.

13. Free Trials and Accounts
If you register for a free trial or free account, access will be granted until the earlier of (a) the trial period’s expiration date, or (b) your purchase of a paid plan. Any data entered during the trial may be deleted after expiration unless a paid subscription is activated.

14. Payment and Renewal
All Services must be prepaid in USD using LCB Tutoring's accepted payment methods. Any subscriptions automatically renew unless canceled at least 3 days before the renewal date. Refunds are not provided once a subscription term has started.

15. Governing Law and Jurisdiction
This Agreement shall be governed by and construed under the laws of the State of Illinois, United States of America, without regard to conflict of law principles. The parties agree that the exclusive jurisdiction for any dispute arising from this Agreement shall be the state and federal courts located in Cook County, Illinois.

 

16. Miscellaneous

• This Agreement constitutes the entire understanding between the parties and supersedes all prior communications.

• If any provision is found invalid, the remaining provisions remain in effect.

• No waiver or amendment is valid unless in writing and signed by both parties.

• You consent to receive all legal notices and communications electronically.

• This Agreement and all related documents are drafted in English.
